Please, read this document carefully. It constitutes the terms of use and the legal notice (hereinafter, the “Terms of Use“) governing the access to and use of the website located at the following URL www.gazvr.com (hereinafter the “Website“).
Access to the Website or its use in any form grants you the status of user (hereinafter, the “User“) and implies the unreserved acceptance of the Terms of Use, GAZ reserving the right to modify them at any time. Consequently, it will be the responsibility of the Users to carefully read the prevailing Terms of Use; in the event of disagreement with any of the points set forth herein, User must abstain from the use of the Website.

GAZ provides the content and services available on the Website, subject to these Terms of Use and the Privacy Policy.

By accessing the Website, the User acquires a right to use the contents, services and/or functionalities of the Website, during the use of the same, and solely for the purpose of enjoying the benefits of the service in accordance with these Terms of Use.
The User may not make use of trademarks or registered trade names, or other distinctive signs, such as the trademark GAZ Virtual Reality ®, whether owned by GAZ or third parties, without the consent of GAZ or its legitimate owners. At no time, unless otherwise expressly provided, access to or use of the Website or its contents grants any right over the distinctive signs included therein.
GAZ reserves all copyright over the contents of the Website. Furthermore, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of the contents included on the Website for public or commercial purposes without the prior, express written authorization of GAZ or, where applicable, of the holder of the corresponding rights.
Likewise, it is forbidden to remove or manipulate the copyright or other credit indications that identify the holders of rights of the contents of the Website, as well as the technical protection devices, fingerprints, or any protection mechanism or information incorporated therein. Likewise, it is not permitted to extract any type of information from the Website by means of any programming technique.
Any content published on the Website must respect the rights of image, intellectual and industrial property that may exist on the same, so the User will be solely responsible for any damage and / or liability that may arise from an infringement of such rights. Similarly, in the event that any User or third party considers that any of the contents of the Website violates their copyright and any other rights, such User must send a communication to info@gazvr.com with the following information:

– Detailed account of the rights allegedly infringed by GAZ, as well as their exact location within the Website.
– Express declaration by the claimant that the use of the contents has been made without the consent of the owner of the rights allegedly infringed.
7.- OBLIGATIONS AND RESPONSIBILITIES OF THE USER
Users agree that they may not use the Website in violation of these Terms of Use. The User is responsible for his/her use of the Website. In addition, the User must comply with any other obligations under applicable law.

• Obtain or attempt to obtain the contents using means or procedures other than those which, as the case may be, have been made available for this purpose or have been expressly indicated on the websites where the contents are found or, in general, those which are habitually used on the Internet, so as not to entail a risk of damage or disablement of the Website and/or the contents.
In particular, and for merely indicative and not exhaustive purposes, the User undertakes not to transmit, disseminate or make available to third parties information, content or files of any kind and, in general, any kind of material that:
• In any case, it is contrary, disregard or attempt against the fundamental rights and public liberties recognized constitutionally, in the International Treaties and in the rest of the current legislation.

• Induces or may induce an unacceptable state of anxiety or fear.
• Induce or incite to get involved in dangerous, risky or harmful practices for the health and the psychic balance.
• Is protected by legislation on copyright, is belonging to GAZ, and the intended use has not been authorized.
• It is contrary to honour, personal and family intimacy or to people’s own image.
• Constitute any type of non-consensual advertising.
• Include any type of virus or program that impedes the normal functioning of the Website.
Failure by the User to comply with any of the foregoing prohibitions will result in the User being solely responsible for any claim that may arise as a result of the same. Even if there is no claim from a third party, GAZ reserves the right to prevent such User from accessing the Website.
GAZ does not control the content posted by Users of the Website and assumes no responsibility for such content. However, GAZ reserves the right to monitor and/or moderate any content posted on the Website that violates these Terms of Use or the Privacy Policy, as well as to edit or remove it.
Likewise, in the event that the Users observe or find any information or content on the Website that could be inappropriate or contrary to current legislation and/or the conditions of the Website, we ask Users to immediately inform GAZ of this circumstance through the different means available for this purpose.

8.1. LINKS TO OTHER WEBSITES
In the event that the Website shows links to Websites by means of different buttons, links, banners, etc., GAZ informs you that these are directly managed by third parties, not being able to control or approve all the information, contents, products or services provided on other platforms to which links may be established from the Website. GAZ may make available to the Users, through different tools and applications, means of link that allow you to access the channels and pages on the Website that GAZ maintains on different platforms and social networks belonging to and/or managed by third parties (e.g. Facebook, Twitter, Instagram, YouTube, LinkedIn, Google+, etc.). Under no circumstances does GAZ share with Facebook, Twitter, Instagram, YouTube, LinkedIn or any other social network that may be incorporated in the future, any type of private information about its Users, its sole purpose being that established in these Terms of Use, as well as in the Privacy Policy of the Website. In this sense, all the information provided to these platforms will be under the responsibility of the User, not intervening GAZ in this process.
The activation and use of these links may lead to identification and authentication as a user (login/password) on the corresponding platforms, completely external to the Website and beyond the control of GAZ. By accessing such external networks, you are entering an environment that is not controlled by GAZ, and GAZ will not assume any responsibility for the security settings of such environments.
Since GAZ has no control over content hosted on such channels, social networks and/or platforms, User acknowledges and agrees that GAZ assumes no responsibility or liability whatsoever for the content or services that may be accessed through such channels, social networks and/or platforms, or for any content, products, services, advertising, or other material available on such channels, social networks and/or platforms. 8.3. LINKS ON OTHER WEBSITES TO THE WEBSITE
GAZ does not authorize the establishment of a link to the Website from those websites which contain unlawful, illegal, degrading, obscene or, in general, in contravention of laws, morals or public order, or generally accepted social norms.
In any case, links to the Website may be established on other websites, provided that they comply with the following conditions:

2) It is not allowed to create a browser or a border environment on the sections of the Website, nor in any other way can the Website be modified;

GAZ assumes no responsibility whatsoever for any aspect of the website that establishes such a link to the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.
9.- LIMITATION OF LIABILITY
GAZ will guarantee, except in cases of force majeure, the correct functioning of the Website, avoiding technical inconveniences, maintenance work during business hours, and any other action that may limit and/or partially interrupt the possibilities of use of the same by Users.
GAZ does not guarantee continued access to, or correct viewing, downloading or use of the elements and information contained in the websites linked to the Website, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. GAZ is not responsible for any decisions that may be taken as a result of access to content or information offered through such linked websites.
GAZ may discontinue the service or terminate the relationship with the User immediately if it detects that use of the Website or any of the services offered on it is contrary to these Terms of Use. GAZ shall not be liable for any damages, losses, claims or expenses arising from the use of the Website. It will only be responsible for eliminating, as soon as possible, the contents that may generate such damage, provided that it is so notified.
In particular, GAZ shall not be liable for any damages that may arise, inter alia, from:

GAZ excludes any liability for damages of any nature that may be due to the misuse of freely available services and use by Users of the Website. GAZ also disclaims any liability for content and information that may be received as a result of unlawful or incorrect use of these services.
10.- INDEMNITY OF GAZ
The User shall defend, indemnify and hold GAZ harmless against any damages arising from claims, actions or demands of third parties as a result of their use of the Website. The User also undertakes to indemnify GAZ against any damages arising out of its use of “robots”, “spiders”, “crawlers” or similar tools used for the purpose of collecting or extracting data or any other action on its part that imposes an unreasonable burden on the operation of the Website.

GAZ reserves the right to change the terms of these Terms of Use at any time in its sole discretion. When this happens, a notice will be included on the Website indicating and informing Users that modifications have been made; and the User will be adequately informed.
The access and use of the Website after the entry into force of the modifications or changes of these Terms of Use supposes its full acceptance and without reservations.

14.- GENERAL
The headings of the clauses are only for information purposes and shall not affect, qualify or extend the interpretation of these Terms of Use. GAZ may also modify the terms and conditions herein, in whole or in part, by posting any changes in the same manner in which these Terms of Use appear or through any type of communication addressed to the Users.
The temporary validity of the present Terms of Use coincides, therefore, with the time of its exposure, until it is totally or partially modified, at which time the modified Terms of Use will come into force.
GAZ may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the Website, without the possibility for Users to demand any compensation whatsoever. After this extinction, the prohibitions of use of the contents previously exposed in the present Terms of Use will remain in force.
If any provision of these Terms of Use is found to be totally or partially null or void, such nullity or unenforceability shall only affect such provision or the part of it that is null or unenforceable, subsisting the Terms of Use in everything else, and being considered such provision totally or partially null and void.
GAZ informs you that it will be able to inform and cooperate in a timely manner with the competent police and judicial authorities if it detects any breach of the legislation in force or if it has any suspicion that a crime has been committed.
GAZ’s failure to exercise or enforce any right or provision contained in these Terms of Use shall not constitute a waiver of such right or provision, unless acknowledged and agreed to in writing by GAZ.
15.- APPLICABLE LAW AND JURISDICTION
The relationship between GAZ and the User shall be governed by current Spanish law, and any dispute shall be submitted to the Courts and Tribunals of the city of Madrid, with express waiver of any other jurisdiction. GAZ will prosecute any breach of these Terms of Use, as well as any improper use of the Website by exercising all civil and criminal actions to which it may be entitled and which assist it in law.

2.- INFORMATION
By accepting this Privacy Policy, the user (hereinafter, the “User” or, when appropriate, the “Users”) is informed that the personal data that he or she provides through the website hosted in the URL www.gazvr.com (hereinafter, the “Website”) will be processed by GAZ, along with the personal data deriving from the browsing activities of the User and those data that he or she may provide in the future.
The User must carefully read this Privacy Policy, written plainly and in a simple way in order to enable a better understanding of data processing so that User may freely and voluntarily determine whether he or she wishes to provide with his or her personal data to GAZ.

Where applicable, the processing of the User’s data by GAZ is based on the legitimate interest pursued by the controller and the consent of the User that is obtained from the User, who might withdraw it at any time. In particular, GAZ processes the data based on the following legal basis:
a) Giving answer to the inquiries made by the Users through the channels provided for this purpose: The processing of data with this purpose is based on the consent of the User, who may withdraw it at any time. In the event that the User withdraws his or her consent, GAZ would not be able to process the enquiry made.
b) Sending of commercial communications: The processing of data with this purpose is based on the consent of the User, who may withdraw it at any time.
7.- WITH WHICH RECIPIENTS WILL THE USER’S DATA BE SHARED?
All the data provided by the User through the Website may be shared with:
• Public Administrations, to the extent necessary to comply with applicable law.
• Courts, to the extent necessary to comply with applicable law.
8.- INTERNATIONAL DATA TRANSFER
The User is informed that GAZ has contracted the services of [Microsoft, Google, and Mailchimp, among others], whose servers are hosted in the USA, which implies an international transfer of data. These international data transfers are regularized as the above-mentioned entities are adhered to the Privacy Shield Protocol.
9.- DATA STORAGE
The data provided by the User will be stored on the Website’s databases for the following periods:
a) Data used to give answer to the inquiries made through the contact channels provided: the data will be stored for the period of time necessary to process and answer the inquiry, and after for the period of prescription of the legal actions deriving from said inquiry.
b) Data used for the sending of commercial communications: the data will be processed for that purpose until the User objects to such processing or withdraws his or her consent.

In no event will GAZ be liable for the third-party promotions offered to the User through their means (as long as the User had consented to receiving them).
11.- LIABILITY OF THE USER
The User guarantees that he or she is over eighteen (18) years old and that the data he or she provides to GAZ is real, accurate, complete and updated. To this effect, the User is responsible for the veracity of the data that he or she provides, and will keep it updated so that it reflects his or her current state.
Likewise, the User guarantees that, when he or she provides personal data concerning third-parties, the User has informed them of the content of this Privacy Policy. b) Right to rectification and erasure:
The User has the right to obtain from GAZ the erasure of personal data concerning him or her where one of the legal grounds applies, among other reasons when the data is no longer necessary for the purposes for which it was gathered. The User also has the right to obtain the rectification of inaccurate personal data concerning him or her.
